There is another concern about this location of files.

Petr may put his files under texmf/tex/csplain, the TDS does not forbid
it. But the TDS implies that he his only the owner of
texmf/tex/csplain/base. So anybody can come with a package and put it in
texmf/tex/csplain/<foo> and the TDS allows it too. How do we get out of
the mess in that case ?
