how about something along these lines:

(1) publishers may include tex live but only as-is; since it's a packaged 
product, this means: the cdrom as it looks now, so no special 
publisher/book specific cover

(2) if they want a special version with a one liner mentioning their name, 
they can ask the tex live group for a master of a cd as well as the 
inprint; since they are quite accustomed to paying for services, they can 
be asked to pay a nominal fee for this

(3) they may in no way claim any copyrights, and should mention explicitly 
where one can get / download a cd i.e. the latest version etc. (this text 
can replace the copyright text they put there now); i can imagine that the 
tl team / user groups prescribe the text

(4) i can even imagine that they 'buy' the cd's for an acceptable price 
since that makes them aware of the fact that efforts like this need support 
(it especially makes sense since these publishers are not that willing to 
respond positively to requests for sponsoring tex conferences).

In all, it would make a real difference if it was the tex live as it is now 
(with the running lion) instead of some vague cover (which much have cost 
them money to make) without any mentioning of tex live and its authors.
