The latter.

This is controlled by \pdfoptionpdfinclusionerrorlevel (since
1.11a) and \pdfoptionpdfminorversion (since 1.10a). See
http://www.pdftex.org/NEWS

Note that \pdfoptionpdfminorversion only sets the integer in the
version key of the pdf; otherwise the file is not changed.
